And now on this day to wit, the the fourteenth day of July in the year last aforesaid come the said complainants by their , and the said defendants John M. Ferris as administrator of the Estate and effects of Joseph Smith deceased widow of said deceased and Lewis C. Bidamon her husband, by their solicitor, and , , and , Infant heirs and children of the said deceased by George W. Meeker their guardian ad litem, appointed by this Court to take care of their interests in the premises.
And this cause coming on to be heard upon the bill, supplemental bill, answers of said Ferris and Bidamon and , also the answer of said guardian ad litem, decree pro confesso Masters’ Report, exhibits and proofs in open Court.
And the Court being fully advised in the premises doth find that there is now due to the said complainants from the estate of the said Joseph Smith deceased the full sum of ($6,546.55) six thousand five hundred and forty six dollars and fifty five cents after deducting sales and a decree of the last term of this Court upon a Judgement in favor of the complainants against the said Joseph Smith now deceased, , , and , obtained in the District Court of the United States for the District of , on the 11th. day of June A. D. 1842, That said Judgement has never been paid, That the other defendants in said Judgement are non-residents of this State and insolvent except who is dead and was at the time of his death insolvent, That on the 18th. day of July A. D. 1842, an was issued on said Judgement to the of this district and afterwards duly returned nullabona.
That said Joseph Smith deceased died seized of Real Estate which had been conveyed to said Joseph Smith by the name and description of Joseph Smith as sole trustee in trust for the Church of Jesus Christ of Latter day Saints, upon which real estate said Judgement at the time of the death of the said deceased was a lien, and which real estate is described as follows to wit:—
