In January 1842, presumably at ’s request, Elliot Roberts, clerk of the Circuit Court in , made certified transcripts of the proceedings in the two 1839 lawsuits. Given that the Caldwell County Courthouse and all original court records were destroyed by fire in 1860, few if any of JS’s original legal papers produced by the Caldwell County Circuit Court are extant.
This document was in ’s possession and presumably was retained by his descendants for an unknown time upon his death. In 1953, it was one of several miscellaneous Boosinger papers in the possession of M. S. MacCarthy of Glendale, California. Sometime between 1953 and 1958, the Boosinger papers were transferred from M. S. MacCarthy to Mrs. H. W. Deegan. In 1958, Deegan sold the Boosinger papers to the Huntington Library, San Marino, California.

at the time and place aforesaid to answer the said action of the said and that you summons all and every person in whose hands or possession any monies, goods, chattels, credits or effects, or evidences of debts of the said defendants may be found to appear at the time and place aforesaid to answer what may be objected against them.
